Mr.Abdullah, who received his Juris Doctorate (JD) degree from Santa Clara University School of Law, and has held membership in the American Immigration Lawyers Association (AILA) since 2008. Since joining the Shah Peerally Law Group in June 2008, he has been serving clients in different areas of immigration and naturalization law. He has had substantial focus on H-1B and L-1A /L-1B petitions, and PERM Labor Certifications underlying professional/skilled worker immigrant petitions. The video sees him talking about, not only how one can find innovative methods to fast forward the application for H-1B Visa, but also deal with problems if it is delayed.

The video is a part of Shah Peerally Law Group’s endeavor at bringing hope for a lot of Indian immigrants facing similar problems. Mr, Abdullah, who has worked in the area of L-1 petitions, and enjoyed success in uniquely challenging “new office” petitions for multinational executives/managers, explains that 221 g, which is a US immigration regulation, has often been mishandled. This, he says is in spite of the fact that a 2001 dept of state guidance tells officers to use the 221g sparingly and only in exceptional cases. Often the applicant is unnecessarily harassed and asked for additional documents of employment, in spite of the fact that relevant documents have already been provided.

Citing other cases, Mr. Abdullah is of the opinion that in such cases, it is in fact better to file a fresh application rather than wait for an elongated period of detailed investigation. Mr. Abdullah cites case studies during his work with Shah Peerally Law Group where, a client with similar problems managed to get her H-1B visa just in time to attend her project, just by filing a fresh application for visa and with additional details of employment including email transactions, etc.

-          You don’t really have to go back to India for obtaining your H-1B Visa

-          If your Visa is filed under 221g and send for further investigation, it is better to re-file your petition

-          When refilling your petition, provide all possible information of communication transaction with employers, including, email, etc to strengthen your case.

-          In case you have changed location of work, or the project has shifted, a fresh petition is better instead of an LCA

Mr. Abdullah in a free wheeling chat in the video tells the audience that an educational degree from the US or Canada could work wonders. In such cases, he advices that a petition for H-1B visa may be filed from either Mexico or Canada, for faster approval.
