Are we desperate to sue?

Courts are being clogged because of too many law suits. It seems that because of the recession, more and more people are resorting to filing a lawsuit with the hope of making some money. Many lawyers are happy to accommodate such behaviors. Yet, such lawsuits can backfire both on the lawyer and the clients.

Frivolous lawsuits are becoming common lately because clients are desperate. As a lawyer, it is our duty to make sure that lawsuits are not being filed just to make someone happy. Frivolous lawsuits can cost you. Indeed, you can be sued for malicious prosecution or charged with abuse of process.

Should we allow such lawsuits? Should the lawyer not check for probable cause?

I think we should not be keen just to file lawsuits when there are no merits to the case.
